Snack World Creator Program

Terms & Agreement

Last Updated: September 3, 2026

These Snack World Creator Program Terms & Agreement (“Terms”) govern participation in the Snack World Creator Program (“Program”).

The Program is operated by Snack World and its applicable owner, operator, parent, affiliated, or related entities (collectively, “Snack World,” “we,” “us,” or “our”).

By applying to, accepting participation in, or participating in the Program, you (“Creator,” “you,” or “your”) acknowledge that you have read, understand, and agree to these Terms.

Participation in the Program is voluntary.

1. Purpose of the Program

The Snack World Creator Program connects Snack World with content creators, influencers, social media personalities, ambassadors, and other individuals who may be interested in creating content featuring Snack World stores, products, events, experiences, promotions, or brands.

Program opportunities may include, but are not limited to:

  • Complimentary products
  • Store visits
  • Product tastings
  • Product reviews
  • Snack challenges
  • Shopping experiences
  • New product launches
  • Event coverage
  • Giveaways
  • Social media content
  • Ambassador opportunities
  • Affiliate or referral opportunities
  • Paid collaborations
  • Other promotional or creative opportunities

Participation in the Program does not guarantee that a Creator will receive any particular opportunity, complimentary product, payment, campaign, or other benefit.

2. Eligibility

Unless Snack World provides written approval otherwise, Creators must:

  1. Be at least eighteen (18) years of age;
  2. Have the legal authority to enter into this Agreement;
  3. Maintain at least one active social media or content platform;
  4. Provide accurate and truthful information in their application;
  5. Comply with these Terms and any campaign-specific requirements;
  6. Comply with applicable laws, regulations, and social media platform rules; and
  7. Be able to participate safely and lawfully in any accepted campaign.

Snack World may establish additional eligibility requirements for individual campaigns.

Snack World reserves the right to approve or decline any application in its discretion.

Submitting an application does not guarantee acceptance into the Program.

3. Application Information

Creators agree to provide complete, current, and accurate information when applying to the Program.

This information may include:

  • Name
  • Contact information
  • Location
  • Social media handles
  • Social media profile URLs
  • Follower or subscriber counts
  • Average views
  • Engagement information
  • Audience information
  • Content categories
  • Content examples
  • Collaboration history
  • Preferred Snack World locations
  • Collaboration interests
  • Other information reasonably necessary to evaluate participation

Creators agree not to intentionally provide false, misleading, manipulated, or materially inaccurate information.

Creators should update their information if material information changes.

Snack World may independently review publicly available social media profiles, content, engagement, audience information, or other publicly available information when evaluating a Creator.

4. Social Media Metrics and Artificial Engagement

Creators must provide social media statistics honestly and accurately to the best of their knowledge.

Creators may not knowingly use or purchase artificial means to misrepresent their influence or performance in connection with the Program, including:

  • Fake followers
  • Purchased followers
  • Fake views
  • Purchased views
  • Engagement bots
  • Automated likes or comments
  • Fake accounts
  • Engagement farms
  • Artificially manipulated audience statistics
  • Other deceptive methods intended to inflate social media performance

Normal paid promotion of legitimate content is not necessarily prohibited, provided it is disclosed to Snack World when relevant to campaign performance reporting.

Snack World may suspend or terminate participation if it reasonably believes a Creator has materially misrepresented social media performance.

5. Creator Account

Approved Creators may be provided access to a Snack World Creator Portal or other online account.

Creator accounts are personal and may not be sold, transferred, shared, or assigned to another person without Snack World’s written permission.

Creators are responsible for:

  • Maintaining the confidentiality of their login credentials;
  • Using a secure password;
  • Providing accurate account information; and
  • Promptly notifying Snack World of suspected unauthorized account access.

Snack World may suspend, restrict, or terminate access to a Creator account at any time if necessary to protect the Program, Snack World, other Creators, customers, or its systems.

6. Creator Status and Program Levels

Snack World may assign Creators different statuses, levels, or tiers.

Examples may include:

  • Applicant
  • Creator
  • Creator Plus
  • Ambassador
  • Featured Creator
  • Inactive Creator

Creator levels may be based on factors such as:

  • Content quality
  • Reliability
  • Audience relevance
  • Local audience concentration
  • Engagement
  • Views
  • Campaign performance
  • Store traffic generated
  • Professionalism
  • Communication
  • Compliance with Program requirements
  • Number of successful collaborations

Creator status, level, or benefits may be changed at any time and do not create an entitlement to future opportunities.

7. Campaign Opportunities

Snack World may make specific campaigns or opportunities available to some or all Creators.

Campaigns may include specific requirements such as:

  • Eligible Snack World location
  • Campaign dates
  • Application deadline
  • Visit deadline
  • Content deadline
  • Product allowance
  • Products available
  • Required platform
  • Number of posts
  • Video or photo requirements
  • Tags or mentions
  • Hashtags
  • Disclosure requirements
  • Campaign theme
  • Content specifications
  • Posting requirements
  • Usage rights
  • Compensation
  • Reporting requirements

These requirements may be provided through the Creator Portal, email, campaign brief, written agreement, or another communication from Snack World.

By accepting a campaign, the Creator agrees to make a reasonable good-faith effort to fulfill the campaign requirements.

Campaign-specific terms supplement these Terms.

If campaign-specific written terms directly conflict with these general Terms, the campaign-specific terms will control solely with respect to that campaign.

8. Campaign Applications and Approval

A Creator expressing interest in or applying for a campaign does not guarantee participation.

Snack World may determine which Creators are selected for each campaign.

Snack World may consider:

  • Creator location
  • Audience location
  • Audience demographics
  • Content style
  • Previous performance
  • Availability
  • Brand fit
  • Campaign objectives
  • Product availability
  • Past collaborations
  • Other relevant factors

Creators should not visit a store expecting complimentary products or other benefits unless the campaign or collaboration has been approved by Snack World.

9. Complimentary Products

Snack World may provide complimentary products, store credit, product allowances, samples, merchandise, experiences, or other benefits to selected Creators.

Unless otherwise stated:

  • Complimentary products have no cash value;
  • Product allowances may only be used for approved products;
  • Unused allowances cannot be redeemed for cash;
  • Product allowances may not be transferred to another person;
  • Snack World may exclude certain products or categories;
  • Product availability is not guaranteed; and
  • Product allowances may expire at the end of the applicable campaign.

Products provided for a Creator collaboration are intended for the Creator’s legitimate participation in the Program.

Creators may not obtain complimentary products through fraud, deception, duplicate accounts, false identities, or misrepresentation.

Creators may not commercially resell complimentary Program products unless Snack World expressly authorizes it.

10. Payment and Paid Collaborations

Participation in the Program does not automatically entitle a Creator to monetary compensation.

Most opportunities may involve complimentary products or experiences rather than payment.

Any paid collaboration must be separately agreed to by Snack World and the Creator.

The applicable campaign terms should identify:

  • Compensation amount
  • Required deliverables
  • Payment method
  • Payment conditions
  • Payment timing
  • Usage rights
  • Any additional requirements

Unless Snack World has expressly agreed in writing to payment, the Creator should not assume that monetary compensation will be provided.

11. Creator Expenses

Unless expressly approved in writing by Snack World, Creators are responsible for their own expenses associated with participating in the Program, including:

  • Transportation
  • Fuel
  • Parking
  • Equipment
  • Internet service
  • Production equipment
  • Editing software
  • Assistants
  • Clothing
  • Props
  • Meals
  • Other production expenses

Creators should not incur expenses expecting reimbursement unless Snack World has approved reimbursement in advance.

12. Creator Independence and Honest Opinions

Snack World wants authentic creator content.

Creators are not required to make false statements, give a positive opinion, or claim to like a product or experience that they did not genuinely like.

Any opinion, review, endorsement, recommendation, or testimonial must reflect the Creator’s honest opinion, finding, belief, or actual experience.

Creators must not:

  • Make statements they know are false;
  • Claim to have tried a product they have not tried;
  • Misrepresent their experience;
  • Fabricate customer experiences;
  • Make unsupported factual claims;
  • Make unsupported medical or health claims;
  • Make misleading claims about Snack World or its products; or
  • Represent an opinion supplied by Snack World as their own genuine opinion.

Snack World may provide talking points, factual information, campaign themes, creative concepts, or suggested messaging.

Creators remain responsible for ensuring that their personal endorsements reflect their genuine experience.

Snack World will not condition complimentary products, payment, or other incentives on a Creator expressing a particular positive or negative opinion unless legally permissible and expressly disclosed.

13. FTC and Advertising Disclosure Requirements

Creators must clearly disclose their relationship with Snack World whenever required by law.

A relationship may require disclosure when the Creator receives anything of value in connection with content, including:

  • Free products
  • Complimentary products
  • Product discounts
  • Store credit
  • Gift cards
  • Payment
  • Commissions
  • Affiliate compensation
  • Free experiences
  • Event access
  • Giveaways
  • Travel or reimbursement
  • Early product access
  • Other benefits or consideration

The disclosure must be clear, understandable, and difficult for an ordinary viewer to miss.

Creators may use appropriate language such as:

  • “Snack World gave me these products to try.”
  • “Gifted by Snack World.”
  • “Thanks to Snack World for providing these products.”
  • “Paid partnership with Snack World.”
  • “Sponsored by Snack World.”
  • “#ad”
  • “#sponsored”

The appropriate disclosure depends on the nature of the relationship.

14. Video Disclosures

When an endorsement is made in a video, disclosure should be included in the video itself when required by applicable law or guidance.

A disclosure should not be hidden solely:

  • In a profile biography;
  • At the bottom of a long caption;
  • Behind a “More” button;
  • Among a large collection of hashtags;
  • On a separate web page; or
  • Somewhere an ordinary viewer is unlikely to notice it.

Where appropriate, Creators should consider both visual and verbal disclosure.

If content is livestreamed, disclosure should be made in a manner reasonably likely to be seen or heard by viewers who enter the livestream at different times.

15. Platform Disclosure Tools

Creators should follow disclosure requirements and branded-content rules established by platforms including, where applicable:

  • TikTok
  • Instagram
  • Facebook
  • YouTube
  • Other social media platforms

Using a platform’s “Paid Partnership,” branded content, sponsored-content, or similar disclosure tool may be required by that platform.

However, Creators should not assume that use of a platform disclosure tool automatically satisfies every applicable legal disclosure requirement.

Creators remain responsible for making legally sufficient disclosures.

16. Reviews on Google, Yelp, Facebook, or Other Review Platforms

Unless expressly permitted by applicable law and the applicable platform’s rules, complimentary products or benefits provided through the Creator Program are not conditioned on a Creator posting a customer review on Google, Yelp, Facebook Reviews, or another consumer-review platform.

Snack World does not require Creators to provide a positive review in exchange for complimentary products, payment, discounts, or other benefits.

Any review voluntarily submitted by a Creator must:

  • Reflect the Creator’s genuine experience;
  • Comply with applicable laws;
  • Comply with the review platform’s rules; and
  • Include any disclosure required because of the Creator’s relationship with Snack World.

17. Content Requirements

Campaign content should comply with the applicable campaign brief.

Unless otherwise authorized, content must not:

  • Include knowingly false or misleading statements;
  • Misrepresent Snack World prices, promotions, policies, locations, or products;
  • Contain unlawful content;
  • Violate another person’s intellectual-property rights;
  • Contain defamatory statements;
  • Contain discriminatory harassment;
  • Contain threats or encouragement of violence;
  • Promote illegal activity;
  • Contain sexually explicit material inappropriate for the campaign;
  • Promote dangerous behavior;
  • Intentionally damage Snack World property;
  • Harass Snack World employees or customers;
  • Disrupt normal store operations; or
  • Create an unreasonable safety hazard.

Snack World may establish additional campaign-specific standards.

18. Food Safety, Allergies, and Dietary Restrictions

Creators are responsible for reviewing product packaging, ingredient statements, allergen warnings, preparation instructions, expiration information, and other applicable product information before consuming or providing products to others.

Creators are responsible for determining whether a product is appropriate for themselves or anyone participating in their content.

Creators should not consume products containing ingredients to which they know they are allergic or sensitive.

Creators should not represent that Snack World has verified that a product is safe for a particular medical condition, allergy, dietary restriction, pregnancy, age group, or individual unless Snack World has expressly made that representation.

Creators should use reasonable judgment when participating in spicy-food challenges, caffeine-related content, eating challenges, or other activities that could create a health or safety risk.

Snack World does not require Creators to participate in unsafe challenges.

19. Filming Inside Snack World Stores

Approved Creators may be permitted to record content inside Snack World locations in connection with approved campaigns.

Creators must conduct themselves safely and respectfully.

Creators may not:

  • Block entrances or exits;
  • Obstruct aisles for unreasonable periods;
  • Create dangerous conditions;
  • Interfere with employees performing their duties;
  • Damage merchandise or property;
  • Harass customers or employees;
  • Enter employee-only areas without permission;
  • Move fixtures or equipment without permission; or
  • Conduct disruptive activities that materially interfere with store operations.

Snack World management may stop or limit filming when reasonably necessary for safety, privacy, security, customer experience, or store operations.

20. Customers, Employees, and Other Persons in Content

Creators are responsible for respecting the privacy and publicity rights of other people appearing prominently in their content.

Creators should obtain appropriate permission before intentionally featuring identifiable customers or other individuals as subjects of content.

Creators should exercise particular care when minors appear in content and should not intentionally feature an unrelated minor as a subject without appropriate parent or guardian permission.

Snack World employees should not be pressured to appear in Creator content.

If an employee declines to participate, the Creator must respect that decision.

21. Third-Party Intellectual Property

Creators are responsible for obtaining any rights reasonably necessary for material they incorporate into their content.

This includes, where applicable:

  • Music
  • Video footage
  • Photographs
  • Artwork
  • Logos
  • Graphics
  • Fonts
  • Audio clips
  • Movie or television clips
  • Other copyrighted material
  • Other individuals’ content

Creators should comply with the applicable platform’s music and content licensing rules.

Creators should notify Snack World if content contains music or other third-party material whose license may restrict Snack World’s ability to repost or reuse that content.

22. Snack World Trademarks and Brand Assets

Snack World may provide Creators with limited permission to use Snack World names, logos, trademarks, mascots, graphics, campaign materials, and other brand assets solely in connection with approved Program activities.

Creators may not:

  • Claim ownership of Snack World trademarks;
  • Register Snack World names or confusingly similar names;
  • Create unauthorized merchandise using Snack World trademarks;
  • Modify Snack World logos in a misleading manner;
  • Imply they own or operate Snack World;
  • Imply an employment relationship that does not exist; or
  • Use Snack World intellectual property outside the Program in a manner that could reasonably cause confusion.

Any permission to use Snack World brand assets may be revoked.

23. Ownership of Creator Content

Unless a campaign-specific written agreement states otherwise, the Creator retains ownership of original content created by the Creator.

Participation in the Creator Program does not automatically transfer ownership of the Creator’s content to Snack World.

24. License to Snack World for Organic Reuse

Unless otherwise stated in the applicable campaign terms, Creator grants Snack World a non-exclusive, worldwide, royalty-free license to reproduce, repost, share, display, distribute, crop, resize, caption, format, and otherwise technically adapt approved Program content for Snack World’s organic marketing and promotional purposes.

Organic use may include:

  • Snack World social media accounts
  • Snack World websites
  • Creator galleries
  • Email newsletters
  • Creator Program pages
  • Internal presentations
  • In-store digital displays
  • In-store promotional materials
  • Public relations relating to the Program
  • Archived social content

Snack World may identify or tag the Creator when reasonably practical.

Snack World will not materially alter a Creator’s message in a manner that falsely changes the Creator’s expressed opinion.

The Creator represents that the Creator has sufficient rights to grant this license, except for third-party materials that the Creator has specifically identified as having separate restrictions.

25. Paid Advertising and Creator Content

Unless the applicable campaign specifically states otherwise, participation in the Program does not automatically grant Snack World unrestricted rights to use Creator content in paid advertising.

Uses such as the following may require additional permission or campaign-specific terms:

  • Meta Partnership Ads
  • TikTok Spark Ads
  • Paid social advertising
  • Television advertising
  • Streaming advertising
  • Digital display advertising
  • Billboards
  • Large-scale print advertising
  • Paid third-party media placements
  • Whitelisting through a Creator’s advertising account
  • Paid use of Creator name, image, or likeness outside ordinary Program promotion

Snack World and the Creator may separately agree to these rights for an individual campaign.

26. Creator Name, Handle, Image, and Likeness

Creator grants Snack World permission to use the Creator’s name, creator name, social media handle, profile photograph, and likeness in reasonable connection with:

  • Administration of the Creator Program;
  • Identifying the Creator as a Program participant;
  • Displaying Creator-created Program content;
  • Crediting or tagging Creator content;
  • Promoting the Creator Program; and
  • Highlighting completed collaborations.

Uses materially outside the ordinary Creator Program or in substantial paid advertising may require additional permission as described elsewhere in these Terms.

27. Content Review and Corrections

Snack World may review campaign content before or after publication when appropriate.

Snack World may request reasonable corrections if content:

  • Omits a required advertising disclosure;
  • Contains inaccurate factual information;
  • Contains an incorrect price or promotion;
  • Violates campaign requirements;
  • Infringes intellectual property;
  • Creates legal or safety concerns;
  • Violates applicable platform policies; or
  • Otherwise materially violates these Terms.

Snack World will not require a Creator to falsely claim to enjoy or recommend a product.

Creators agree to reasonably cooperate with legitimate compliance-related correction requests.

28. Posting Deadlines

Creators who accept campaigns should make reasonable efforts to complete required content within the campaign deadline.

If circumstances prevent timely completion, the Creator should contact Snack World as soon as reasonably possible.

Repeated acceptance of complimentary products followed by failure to complete agreed campaign requirements may result in:

  • Reduced access to future campaigns;
  • Removal from a campaign;
  • Creator-level adjustment;
  • Suspension; or
  • Removal from the Program.

Snack World may establish additional consequences in individual campaign terms when appropriate.

29. Content Submission

Creators may be required to submit links to completed content through the Creator Portal or another method designated by Snack World.

Requested information may include:

  • Content URL
  • Social platform
  • Posting date
  • Views
  • Likes
  • Comments
  • Shares
  • Saves
  • Other performance information

Creators agree to provide performance information honestly and accurately to the best of their knowledge.

30. Campaign Performance

Snack World may evaluate campaign performance using information including:

  • Views
  • Reach
  • Engagement
  • Likes
  • Comments
  • Shares
  • Saves
  • Audience location
  • Store traffic
  • Referral activity
  • Sales
  • Customer feedback
  • Creator reliability
  • Content quality

Performance may influence selection for future campaigns.

Snack World does not guarantee any Creator a particular level of exposure, follower growth, engagement, compensation, or future opportunity.

31. No Guaranteed Results

Snack World makes no guarantee regarding:

  • Views
  • Follower growth
  • Engagement
  • Virality
  • Platform algorithms
  • Creator earnings
  • Affiliate revenue
  • Publicity
  • Future campaigns
  • Creator status
  • Paid opportunities
  • Long-term participation

Social media performance may fluctuate for reasons beyond Snack World’s control.

32. Creator Professional Conduct

Creators representing themselves as participants in the Snack World Creator Program are expected to behave professionally.

Serious misconduct that may result in removal from the Program includes:

  • Fraud
  • Theft
  • Threats
  • Harassment
  • Discrimination
  • Violence
  • Intentional property damage
  • Deceptive conduct
  • Serious abuse of Program benefits
  • Falsification of performance data
  • Repeated failure to comply with campaign obligations
  • Conduct that creates a legitimate safety concern
  • Material violations of law

Snack World will consider the nature and circumstances of any issue before taking action when reasonably appropriate.

33. Confidential Information and Embargoes

Creators may receive non-public information in connection with certain campaigns.

Examples include:

  • Unreleased products
  • Launch dates
  • Confidential promotions
  • Embargoed information
  • Private campaign materials
  • Internal pricing information
  • Business plans
  • Non-public store information
  • Access codes
  • Private Creator Portal information

Creators agree not to publicly disclose information that Snack World clearly identifies as confidential or embargoed before the authorized release date.

Information that is already lawfully public is not confidential merely because the Creator learned about it through the Program.

34. Giveaways and Contests

Creators may not independently represent that Snack World is sponsoring a giveaway, contest, sweepstakes, or promotion unless Snack World has approved the promotion.

Any approved giveaway or contest must comply with:

  • Applicable law;
  • Platform rules;
  • Campaign requirements; and
  • Any official rules provided by Snack World.

Creators may not alter material giveaway terms without authorization.

35. Discounts, Promo Codes, and Affiliate Links

Snack World may provide Creators with:

  • Promotional codes
  • Tracking links
  • Affiliate links
  • Referral identifiers
  • Other attribution methods

Creators may only represent the terms of an offer accurately.

Creators must not:

  • Alter expiration dates;
  • Invent discounts;
  • Misrepresent eligibility;
  • Publish unauthorized coupon codes;
  • Promise benefits Snack World has not approved; or
  • Engage in fraudulent self-referrals or other manipulation.

Commission or affiliate terms, if applicable, will be separately provided.

36. Exclusivity

Unless otherwise specified in a campaign-specific written agreement, participation in the Snack World Creator Program is non-exclusive.

Creators may generally work with other brands and businesses.

Specific campaigns may include limited exclusivity requirements if disclosed before the Creator accepts the campaign.

37. No Employment or Agency Relationship

Participation in the Program does not create an employment relationship between the Creator and Snack World.

Unless specifically stated in a separate written agreement, the Creator is not:

  • An employee of Snack World;
  • An agent authorized to bind Snack World;
  • A franchisee;
  • A partner in the legal sense;
  • A representative authorized to enter contracts for Snack World; or
  • Authorized to make commitments on behalf of Snack World.

Creators control the manner and methods used to create their content, subject to agreed campaign requirements and applicable law.

Creators may not represent that they have authority to speak on behalf of Snack World unless specifically authorized.

38. Taxes

Creators are responsible for determining and satisfying their own federal, state, and local tax obligations arising from compensation or benefits received through the Program.

Snack World may request tax documentation and may issue tax forms when required by applicable law.

Creators participating in paid opportunities agree to provide legally required tax information when requested.

39. Privacy and Data

Snack World may collect and process information reasonably necessary to:

  • Evaluate Program applications;
  • Administer Creator accounts;
  • Communicate with Creators;
  • Match Creators with campaigns;
  • Manage collaborations;
  • Track campaign performance;
  • Prevent fraud or abuse;
  • Maintain records; and
  • Comply with legal obligations.

Personal information will be handled in accordance with Snack World’s applicable Privacy Policy and applicable law.

Creators should review the Snack World Privacy Policy before submitting an application.

40. Email Communications

Creators understand that Snack World may send transactional or Program-related email communications reasonably necessary to administer participation, including:

  • Application status
  • Account information
  • Campaign invitations
  • Campaign approvals
  • Campaign deadlines
  • Content requests
  • Program policy changes
  • Security notices
  • Administrative communications

Marketing communications may be subject to separate consent and opt-out requirements.

41. Text Messages

If Snack World offers SMS or text-message notifications, consent to receive promotional text messages should be obtained separately where required.

Participation in the Creator Program should not be conditioned on agreeing to receive promotional marketing text messages unless legally permitted.

Message and data rates may apply.

Creators may opt out of promotional SMS communications according to the instructions provided with those messages.

Essential account communications may be sent through other available methods.

42. Program Changes

Snack World may modify, suspend, expand, reduce, or discontinue portions of the Creator Program.

Snack World may also update these Terms from time to time.

If changes materially affect Creator rights or obligations, Snack World may provide notice through:

  • Email;
  • The Creator Portal;
  • The Program website; or
  • Another reasonable method.

Continued participation after updated Terms become effective may constitute acceptance of the updated Terms to the extent permitted by law.

43. Creator Withdrawal

Creators may stop participating in the Program at any time by notifying Snack World or using available account controls.

Withdrawal does not automatically eliminate obligations associated with previously accepted or completed campaigns.

Any rights previously granted for completed Program content will continue according to the applicable campaign terms and these Terms.

44. Suspension or Termination

Snack World may suspend or terminate a Creator’s participation if the Creator:

  • Materially violates these Terms;
  • Repeatedly fails to fulfill accepted campaigns;
  • Provides fraudulent information;
  • Abuses complimentary-product benefits;
  • Engages in serious misconduct;
  • Violates applicable law;
  • Creates a legitimate safety or security risk;
  • Misuses Snack World intellectual property;
  • Artificially manipulates campaign performance;
  • Fails to provide required sponsorship disclosures after notice; or
  • Otherwise engages in material conduct inconsistent with the Program.

Snack World may also discontinue a Creator relationship for legitimate business reasons unrelated to misconduct.

Termination does not automatically revoke licenses or rights already validly granted for previously completed campaign content.

45. Campaign Cancellation

Snack World may cancel or modify a campaign because of:

  • Product availability
  • Store operations
  • Weather
  • Safety concerns
  • Business conditions
  • Campaign performance
  • Errors
  • Platform changes
  • Legal or regulatory issues
  • Events outside Snack World’s reasonable control

Snack World will make reasonable efforts to notify affected Creators.

Unless separately agreed, Snack World is not responsible for Creator expenses resulting from a campaign cancellation.

46. Representations by Creator

Creator represents and warrants that:

  1. Creator has authority to agree to these Terms;
  2. Information provided to Snack World is materially accurate;
  3. Original Creator content will not knowingly infringe the rights of others;
  4. Creator will make required advertising disclosures;
  5. Creator will not knowingly make false or misleading endorsements;
  6. Creator will comply with applicable laws and platform requirements;
  7. Creator will not knowingly misrepresent social media metrics; and
  8. Creator will not grant Snack World rights that the Creator does not have authority to grant.

47. Indemnification

To the extent permitted by law, Creator agrees to defend, indemnify, and hold harmless Snack World, its owners, affiliates, officers, employees, and agents from third-party claims, losses, damages, liabilities, and reasonable costs arising directly from:

  • Creator’s material breach of these Terms;
  • Creator’s unlawful conduct;
  • Creator’s infringement of third-party intellectual-property rights;
  • Creator’s unauthorized use of another person’s image or likeness;
  • Creator’s knowingly false or misleading statements; or
  • Creator’s negligent or intentional misconduct in connection with the Program.

This provision does not require Creator to indemnify Snack World for claims caused solely by Snack World’s own unlawful conduct, gross negligence, or willful misconduct.

48. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SNACK WORLD WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM PARTICIPATION IN THE PROGRAM, INCLUDING LOST FOLLOWERS, LOST REVENUE, LOST BUSINESS OPPORTUNITIES, OR LOST SOCIAL MEDIA REACH.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SNACK WORLD’S AGGREGATE LIABILITY ARISING FROM A PARTICULAR CAMPAIGN WILL NOT EXCEED THE GREATER OF:

(A) THE AMOUNT OF MONETARY COMPENSATION ACTUALLY PAID TO CREATOR FOR THAT CAMPAIGN; OR

(B) FIVE HUNDRED DOLLARS ($500).

Nothing in these Terms excludes liability that cannot lawfully be limited or excluded.

49. Assumption of Ordinary Risks

Creators voluntarily participate in store visits, food tastings, product demonstrations, events, and other Program activities.

Creators are responsible for exercising reasonable care and judgment.

Nothing in these Terms releases Snack World from responsibility for liability that cannot lawfully be waived.

50. Force Majeure

Neither Snack World nor Creator will be responsible for failure or delay in performing an obligation when performance is prevented by circumstances beyond the party’s reasonable control, including:

  • Severe weather
  • Natural disasters
  • Fire
  • Government orders
  • Public emergencies
  • Utility failures
  • Internet or platform outages
  • Labor disruptions
  • Transportation interruptions
  • Product recalls
  • Other comparable events beyond reasonable control

The affected party should provide reasonable notice when practical.

51. Governing Law

These Terms will be governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles, except where federal law or another applicable law controls.

52. Venue

Unless applicable law requires otherwise, legal proceedings arising directly from these Terms will be brought in a state or federal court having jurisdiction in or serving Jefferson County, Kentucky.

Nothing in this section prevents either party from seeking appropriate relief in another jurisdiction when necessary to protect intellectual-property rights or when required by applicable law.

53. Good-Faith Resolution of Disputes

Before filing a lawsuit relating to the Program, Snack World and Creator agree, when reasonably practical, to first attempt in good faith to resolve the dispute informally.

A party may provide written notice describing the issue and requested resolution.

This requirement does not prevent either party from seeking emergency or injunctive relief when reasonably necessary.

54. Severability

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed if necessary.

The remaining provisions will remain in effect.

55. No Waiver

Failure by Snack World to enforce a provision of these Terms on one occasion does not waive its right to enforce that provision or another provision in the future.

56. Assignment

Creators may not transfer or assign their Creator Program account, campaign obligations, or rights under these Terms to another person without Snack World’s written approval.

Snack World may assign these Terms to an affiliate, successor, purchaser, or entity that acquires or operates the applicable Snack World business, subject to applicable law.

57. Entire Agreement

These Terms, together with:

  • Applicable campaign terms;
  • Campaign briefs;
  • The Snack World Privacy Policy;
  • Any specific written compensation or content-usage agreement; and
  • Other policies expressly incorporated by reference

constitute the applicable agreement concerning participation in the Program.

A campaign-specific agreement may supplement or modify these Terms for that campaign.

58. Electronic Acceptance

Creator agrees that electronic acceptance of these Terms has the same effect as signing an agreement electronically to the extent permitted by applicable law.

Electronic acceptance may include checking a required checkbox and submitting the Creator Program application or accepting updated Program Terms through the Creator Portal.

Snack World may maintain electronic records showing:

  • Date and time of acceptance;
  • Version of Terms accepted;
  • Creator account or application identifier;
  • IP address or other security information when appropriate; and
  • Other information reasonably necessary to document acceptance.
